At Mercers Law, our expert commercial team will advise and where appropriate, negotiate, agree, or draft loan documentation such as bank charges, legal charges, or mortgages on your behalf.

    Our Commercial Property solicitors can also deal with collateral securities such as third-party charges, personal guarantees, and debentures to ensure your commercial property transition runs smoothly.


  • Leases are complex documents, whether the form is long or short. Unexpected liabilities may arise not only out of what is mentioned in lease documents but also in what is not mentioned. We can advise on whether they are consistent with what you believe you have agreed.

    Leases govern, amongst other things:

    • Tenant’s and the landlord’s rights
    • Liability for repairs, maintenance, and decoration
    • Alterations and tenant’s use
    • Rent and rent reviews
    • Security of tenure and tenant’s ability to assign (transfer or sell) the lease
    • Shorter form or duration leases may contain less onerous liability than leases for a longer period, however, this is not always the case

    We will ensure, whether you are a landlord or a tenant, that you are aware of the material liabilities on the parties, and whether these are consistent with the market. We will negotiate specifics on your behalf, on your instructions.

    We can also advise you on the terms of your existing lease. We regularly advise on selling (or assigning) leases and buying existing leases, taking new leases, granting new leases and subletting, renewing and rent reviews, consents or licenses to assign, sublet, or charge and consents or licences for alterations.
